立法院外交及國防委員會上午審議「兵役法施行法部分條文修正草案」及「台聯黨團擬具兵役法施行法第30條條文修正草案」，國防部副部長李翔宙列席報告表示，此案主要是配合役男赴國外或大陸地區就學的需要，在不影響兵役義務履行，且仍受各類學位修業年齡上限管制的前提下，適度放寬役男出境就學年齡限制；且為合理劃分機關權責，將規範兵役行政事項的兵籍規則3種法規，分別授權國防部及內政部訂定。而台黨團所提兵役法施行法第30條修正條文，符合消除婦女一切形式歧視公約規範，執行上並無窒礙，擬配合辦理修正。

李翔宙說，草案放寬役男出境就學規定的限制，刪除出境就學不得逾徵兵及齡19歲之年12月31日的規定，但仍維持就學最高年齡，大學至24歲，研究所至27歲，博士班30歲及學制超過4年者，每增加1年，得延長就學最高年齡1年，博士班就讀最高年齡以33歲為限的規定，將原出境返國停留時間不得逾兩個月規定，放寬至不得逾3個月。

他說，現行後備軍人及補充兵，具同父兄弟中已有半數以上在營服役條件者，得列入儘後召集的條件，為符合憲法及消除對婦女一切形式歧視公約所揭性別平等的精神，因此修正為具兄弟姊妹中有半數以上在營服役條件者。
